Abstract

This paper dealt with a human rights rhetorical and argumentative theory outline, based on Narbal de Marsillac’s thinking. This author has been working with rhetoric, philosophy and human rights for a decade and a half. It was found that at least three themes are recurrent in his publications, namely: a discussion of an argumentative theory of knowledge, a review of the concept of reason and the problem of justification of human rights in an intercultural perspective. What was attempted was to outline, in its most general and, still, unspecified lines, a rhetorical and argumentative theory of human rights. The starting point was to understand the attempt to formulate an argumentative theory of knowledge. Then, the way in which a review of the concept of reason was proposed, highlighting the historicity of that concept. Finally, the dialogue with his topicrhetorical and pragmatic approach to human rights. This considers the problem of dialogicity in the construction of texts about these rights. As a result, it emphasizes a multicultural participation with the intention of increasingly broad inclusion of cultures that start from different foundational topos. And yet, of a conception of human rights that fosters a notion of solidarity that expands the social side and implies a commitment to the elimination of all forms of humiliation and cruelty, and replacing the notion of transculturality with that of interculturality.
